Trybely Terms of Service
Effective date: October 1, 2026
Last updated: October 1, 2026
These Terms of Service ("Terms") are an agreement between you and SoftPro Solution, doing business as Trybely ("Trybely", "we", "us") and govern your use of trybely.com, the Trybely apps for iPhone and Android, Aurex (our AI business assistant), and related services (the "Services"). By creating an account or using the Services you agree to these Terms and to our Privacy Policy at https://trybely.com/privacy/.
If you use the Services on behalf of a business, you confirm you are authorised to accept these Terms for that business, and "you" includes the business.
1. Eligibility and accounts
- You must be at least 18 years old and able to form a binding contract.
- Give accurate information and keep it up to date. Keep your password and staff PINs confidential. You are responsible for activity under your account, including by staff you invite.
- Call us right away at 774-415-0001 if you suspect unauthorised use.
- You can delete your account at any time in Settings → Account Settings → Delete my account, or as described at https://trybely.com/delete-account/.
2. The Services
Trybely provides tools for running a business, including point of sale, inventory and barcode scanning, staff and time clock, customer loyalty, bookings, invoicing and accounting, marketing, a social feed, and Aurex. Features may vary by plan and may change over time. We may add, change or remove features, and we will give reasonable notice of changes that materially reduce paid features.
3. Plans, payments, refunds and returns
- Some features require a paid subscription or membership. Prices, billing period and what is included are shown before you buy.
- Payments are processed by Stripe. Stripe's terms also apply to payments. Charges from Trybely appear on your card statement as TRYBELY.
- Taxes may be added where required.
Subscriptions — one-year commitment
- Every subscription is a one-year commitment that starts on the day you subscribe, even if it is billed monthly. By subscribing you agree to pay for the full one-year term and authorise Stripe to charge your payment method for it.
- You can cancel at any time in your account so that the subscription does not renew. Cancellation takes effect at the end of the current one-year term, and you keep access until then.
- Except under the 30-day return policy below or where required by law, subscription fees for the one-year term are not refundable, including if you stop using the Services early. Deleting your account cancels your subscription immediately and stops any further charges, but does not refund amounts already paid.
Hardware — sold outright, no refunds
- Hardware (for example card readers, receipt printers, scanners, cash drawers and other devices) is sold outright and becomes yours once paid for.
- All hardware sales are final. Hardware is not refundable and cannot be returned for a refund, including under the 30-day return policy. This does not limit any manufacturer's warranty or any rights you have by law for defective products.
30-day return policy
- Except for hardware, you may return a purchase from Trybely within 30 days of the purchase date for a refund to your original payment method. For a new subscription, this means you may cancel within the first 30 days for a refund; after 30 days the one-year commitment above applies.
- To request a return or refund, call us at 774-415-0001.
- The hardware rule above always overrides this 30-day return policy: hardware is never refundable.
Other purchases
- Purchases made through the Apple App Store or Google Play (if offered) are governed by that store's terms, including its refund rules.
- Card payments taken by businesses (for example at the POS) are between the business and its customer and are processed by the payment provider the business connects. The business is responsible for its own sales, refunds, chargebacks, taxes and receipts.
4. Your content and business data
- You keep ownership of the content and data you put into the Services ("Your Content"), including business records, photos, posts and documents.
- You give Trybely a limited licence to host, store, process, display and transmit Your Content only to provide, secure and improve the Services, and as described in the Privacy Policy (including sending requests to AI providers when you use AI features).
- Content you choose to make public (for example posts, reviews or a business listing) can be seen by other users.
- You are responsible for Your Content and for having the rights and consents needed to upload it, including personal information about your customers and employees. As a business, you are responsible for complying with laws that apply to your business (for example consumer, employment, privacy, tax, age-restricted sales and record-keeping laws).
- You can export or delete Your Content as the Services allow. After account deletion we keep only the records the law requires, as described in the Privacy Policy.
5. Acceptable use
You agree not to:
- break the law, infringe others' rights, or upload content that is unlawful, harassing, hateful, sexually explicit, violent or misleading;
- send spam or unsolicited marketing, or collect other users' information without permission;
- upload malware, probe or attack the Services, bypass security or access controls, or access accounts or data that are not yours;
- scrape, copy or reverse engineer the Services except as allowed by law;
- use the Services to build a competing product, or resell them without our written permission;
- misuse AI features to generate unlawful content or to impersonate others.
We may remove content, limit features, or suspend or close accounts that break these Terms. Users can report abusive content or users by calling 774-415-0001 or through the in-app report option.
6. Aurex and AI features
AI features generate output automatically and can be inaccurate or incomplete. Output is not professional advice (including legal, tax, accounting, financial or employment advice). Review important results before acting on them. You are responsible for how you use AI output. Do not submit information to AI features that you are not allowed to share.
7. Third-party services
The Services connect to third-party services such as Stripe, Google and Facebook sign-in, AI model providers, and app stores. Your use of those services is governed by their terms, and we are not responsible for them.
8. Intellectual property
The Services, including the software, design, the Trybely and Aurex names and logos, are owned by Trybely or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services under these Terms. Feedback you give us may be used without obligation to you.
9. Availability and changes
We work to keep the Services available and secure, but they are provided on an "as is" and "as available" basis and may be interrupted for maintenance, updates or reasons outside our control. Keep your own copies of records you are legally required to retain. We do not offer an uptime or service-level guarantee unless we agree to one with you in writing.
10. Disclaimers
To the fullest extent permitted by law, Trybely disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement and accuracy. Some jurisdictions do not allow these exclusions, so some may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, Trybely will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Trybely's total liability for any claim relating to the Services is limited to the greater of the amount you paid Trybely in the 12 months before the claim or US$100. Nothing in these Terms limits liability that cannot be limited by law.
12. Indemnity
You will defend and indemnify Trybely against claims arising from Your Content, your business's dealings with its customers and employees, or your breach of these Terms or the law, to the extent permitted by law.
13. Termination
You can stop using the Services and delete your account at any time. We may suspend or end your access if you break these Terms, if required by law, or if we discontinue the Services (with reasonable notice where possible). Sections that by their nature should survive (for example payments owed, Your Content licence for retained records, disclaimers, limitation of liability, indemnity and governing law) survive termination.
14. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Massachusetts, unless applicable law gives you the right to bring a claim where you live.
15. Apple App Store terms
If you downloaded the iOS app, you acknowledge that these Terms are between you and Trybely, not Apple; Apple is not responsible for the app or its content, has no obligation to provide support or maintenance, and is not responsible for any claims relating to the app (including product liability, legal compliance or intellectual-property claims). If the app fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); to the maximum extent permitted by law Apple has no other warranty obligation. You confirm you are not located in a country subject to a US Government embargo or on a US Government restricted-party list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
16. Changes to these Terms
We may update these Terms. If changes are material, we will notify you in the app or by email at least 15 days before they take effect. Continuing to use the Services after that means you accept the updated Terms.
17. General
These Terms and the Privacy Policy are the entire agreement between you and Trybely about the Services. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
